By installing, accessing, or using the Curie Shopping application ("App") on the Shopify App Store, you ("Merchant," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not install or use the App.
These Terms are between you and Curie Vision, Inc. ("Curie," "we," "us," or "our"). Your use of the App is also subject to the Shopify Terms of Service and our Privacy Policy.
Curie Shopping provides AI-powered conversational shopping, 3D product model generation, and agentic commerce capabilities for Shopify merchants. The App includes:
To use the App, you must have a valid Shopify store. By installing the App, you authorize us to access your store data as described in our Privacy Policy and as permitted by the Shopify API scopes you approve during installation.
You are responsible for maintaining the security of your Shopify account and any API keys generated by the App. You agree to notify us immediately of any unauthorized access or use of your account.
The App offers both free and paid subscription plans. Paid plans are billed through the Shopify Billing API and will appear on your Shopify invoice.
The App uses a credit-based system for AI operations. Different actions consume different amounts of credits:
Unused credits do not roll over between billing periods. Credit allocations are subject to change with 30 days notice.
You agree not to:
Our IP: The App, including its source code, design, AI models, and documentation, is owned by Curie Vision, Inc. and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App in connection with your Shopify store.
Your content: You retain all rights to your product data, images, and other content. By using the App, you grant us a limited license to process this content solely for the purpose of providing the App's features (e.g., AI processing, 3D model generation).
Generated 3D models: 3D models generated by the App from your product images are owned by you and may be used freely in connection with your business.
Our collection and use of data is governed by our Privacy Policy. By using the App, you consent to our data practices as described therein.
We comply with Shopify's mandatory GDPR webhooks. When you uninstall the App or when Shopify sends a data erasure request, we will delete your data as described in our Privacy Policy.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or secure. AI-generated content, including 3D models and conversational responses, may contain inaccuracies. You are responsible for reviewing AI-generated content before publishing it on your store.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURIE VISION, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Curie Vision, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
Either party may terminate these Terms at any time. You may terminate by uninstalling the App. We may terminate or suspend your access if you violate these Terms or engage in abusive behavior.
Upon termination, your license to use the App ceases immediately. We will delete your data in accordance with our Privacy Policy and Shopify's GDPR requirements.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Continued use of the App after changes constitutes acceptance. If you disagree with changes, you may uninstall the App.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.
